The Town of Fort Myers Beach Council voted to approve instructing staff to meet with La Ola owner Tom Houghton and his attorney and take part in mediation over a code violation regarding the property which has been in appeal in Lee County Circuit Court since last year. The council voted against a settlement offer that had been proposed by Houghton. Fort Myers Beach Mayor Dan Allers said “We think we are close. I think there is something that can continue.” Allers will be taking part in the mediation proceedings, which he said he hopes will allow La Ola to continue going forward. The code violation revolves around the use of a trailer on the property which had been cited in a FEMA complaint. The business was destroyed by Hurricane Ian and has been operating out of temporary trailers.
